For several years SK&S has been providing legal services to one of the largest Polish banks with respect to the restructuring and enforcement of receivables. Our service covers, in particular, analysis of the loan and security documentation, court execution of the receivables, exercising of security; in particular pledges on shares in special purpose companies and mortgages, development of strategies aimed at taking over real estate or shares in special purpose companies, drafting letters and agreements in this respect, representing the bank in litigation, including Pauline actions seeking to satisfy the bank’s receivables following the actions of the debtors performed with a detrimental effect on the bank, actions for compensation against third parties acting to the detriment of the bank in agreement with the debtor, defence from Pauline actions of other debtors questioning the establishment or exercise of securities established for the bank, development of ideas and subsequently draft arrangements with the bank’s debtors and the negotiation thereof and representing the bank in bankruptcy proceedings of the bankrupt debtors, both in liquidation and with the possibility of reaching a settlement.
