Litigation

Print version

The Litigation Department of SK&S, headed by Dariusz Skuza (formerly an experienced civil court judge), provides advice on dispute resolution before civil courts, courts of arbitration, and the Supreme Administrative Court. We represent clients in all types of proceedings at all stages, from comprehensive case preparation and management, collecting evidence and filing statements of case, to settlement negotiations and participation in proceedings and finally the enforcement of judgments.

Among the numerous cases conducted by the Litigation Department, particularly worth noting are its most spectacular successes. The law firm successfully represented the Polish Government in international arbitration disputes with two global telecom operators; we have managed numerous disputes regarding the protection of foreign investments; we procured a settlement in respect of multi-million claims of one of the largest Polish banks in a landmark case concerning a government-guaranteed loan to one of the largest Polish coal mine holdings and effectively enforced multi-million debts under a loan on behalf of another large Polish bank. Numerous proceedings conducted by the Litigation Department concern the protection of intellectual and industrial property and unfair competition (e.g. cases concerning "Królewska", "Chopin" and "Belvedere" vodka brands and cases concerning producers from the pharmaceutical and cosmetics sectors). We have had significant success in administrative proceedings before the Supreme Administrative Court (e.g. in cases concerning fees and fines connected with environmental exploitation and protection). We have also enjoyed success in arbitration proceedings, including for example in respect of companies from the Elektrim S.A. group, and in insolvency proceedings.

Since the law firm's inception, the number of cases conducted by the Litigation Department has significantly exceeded 1000.
