Aviation

We are seasoned advisers to the aviation sector. We assisted the largest Central European carrier when, more than a decade ago, it successfully launched its operations in Poland, and we take pride in the fact that we have worked together ever since. We have also advised, long-term, one of the world’s largest shipping companies, both on general regulatory matters, and on the laws governing air carriage.

Our experience includes, i.a.:

Regulatory matters

We have acted in numerous proceedings before the President of Poland’s Civil Aviation Authority (Urząd Lotnictwa Cywilnego) concerned with launching and pursuing concerns in the aviation business, including obtaining authorisation or limited air traffic rights, and those concerned with air security. We also act in other administrative proceedings in particular those that organize air traffic, and concern the approval of airport charges or adjustments to airport rules.

Contracts

We have participated in negotiations with the managers of over a dozen airports in Poland and in other European countries to agree cooperation agreements, base airport agreements among them. We have also negotiated contracts with the providers of ground services. We have advised clients on the process of drafting general terms of air carriage, and on agency contracts in the aviation sector.

Labour law

We provide comprehensive legal assistance on employment matters. Our counsel covers industry-specific rules applicable to aviation personnel.

Litigation

We represent clients in their disputes with airports. We have handled civil and criminal law cases concerned with aviation incidents and accidents. We represent airlines in proceedings brought up by passengers, including those to obtain compensation under Regulation 261/2004.

Purchase and sale of aircraft

We have advised clients on the purchase of aircraft. We have also represented clients in aircraft sale transactions, including those through public procurement procedures. In a tender for the sale to the Polish authorities of small aircraft to carry VIPs, we advised the winning bidder. We have also advised on the sale of aircraft to the Border Guard (Straż Graniczna).
