SK&S advised the Budimex-Gülermak consortium on a tender worth approximately PLN 2 billion gross

Dr. Łukasz Goniak represented a consortium composed of Gülermak S.A., Budimex S.A., and Budimex Kolejnictwo S.A. in a public tender organized by PKP Polskie Linie Kolejowe S.A. The procedure concerned the construction of a new section of railway line no. 622 between Szczyrzyc and Tymbark, as part of the “Podłęże-Piekiełko” project. The contract was signed on October 6 during a press briefing held at the PKP Polskie Linie Kolejowe S.A. headquarters in Kraków.
During the proceedings, the National Appeals Chamber issued one of its first and most significant rulings on the exclusion of contractors from non-GPA countries. The Chamber, in accordance with the request of the consortium's representatives, confirmed that contractors from third countries without an appropriate agreement do not have the right to appeal against the decisions of contracting authorities. This decision is expected to have a meaningful impact on future public procurement in Poland.
The investment includes both design documentation and the construction of modern railway infrastructure, such as two tunnels totaling nearly 5 kilometers in length, bridges, viaducts, grade-separated crossings, and a new passenger stop in Stróża. The line will be adapted for speeds of up to 160 km/h for passenger trains and 120 km/h for freight.
The consortium we represented submitted the winning bid, with the contract valued at around PLN 2 billion.
