SK&S represented the Gülermak–Intop consortium in proceedings concerning a rail contract worth approx. PLN 1.6 billion

Dr. Łukasz Goniak represented the consortium of Gülermak S.A. and INTOP Warszawa Sp. z o.o., providing comprehensive legal support in the public procurement proceedings and in the proceedings before the National Appeals Chamber (Krajowa Izba Odwoławcza – KIO), concerning a tender conducted by PKP Polskie Linie Kolejowe S.A. for construction works on railway line No. 104 on the Tymbark–Limanowa section, as part of the "Podłęże–Piekiełko" project.

The case concerned one of the largest infrastructure contracts currently being implemented in Poland’s rail sector, with an estimated value of approximately PLN 1.6 billion. Despite the contracting authority having earlier upheld an appeal filed by a competing bidder, the National Appeals Chamber confirmed the position presented by the consortium’s counsel, concluding that the Gülermak–Intop bid had been selected correctly. As a result of the outcome of the proceedings, the consortium signed the contract with the contracting authority on March 12, 2026.

The investment involves the construction of a key section of the new railway line No. 104, which forms part of the strategic “Podłęże–Piekiełko” rail project aimed at significantly reducing travel time between Kraków and the southern part of the Małopolska region, as well as improving the region’s transportation accessibility.
