Final and Binding Victory for TOK FM before the Court of Appeal

On 26 February 2026, the Warsaw Court of Appeal dismissed the appeal lodged by the former Chair of the National Broadcasting Council (KRRiT) against the first‑instance judgment issued in favor of TOK FM (Inforadio). This marks the final conclusion of another case, in which SK&S attorneys defended a radio broadcaster against penalties imposed for criticizing public authorities in the broad sense.

The Court confirmed that the decision imposing a financial penalty on the broadcaster was unfounded and that the limits of permissible journalistic criticism are broad. It found no elements of hate speech, incitement to discrimination or any unlawful content in the broadcasts challenged by the regulator.

This judgment marks another success for our firm in disputes involving the KRRiT. In all cases handled by our team concerning penalties imposed on TOK FM (Inforadio), all decisions have been legally overturned.
