Final victory for SK&S on behalf of Eurocash in dispute with President of UOKiK

SK&S lawyers successfully represented Eurocash in a dispute with the President of UOKiK concerning a decision imposing a fine of PLN 76 million on the Client for alleged unfair exploitation of contractual advantage.

On January 27, 2026, the Court of Appeal in Warsaw issued a final judgment dismissing the appeal brought by the President of UOKiK, thereby upholding the ruling favorable to the Client issued by the Court of Competition and Consumer Protection dated February 19, 2024. As a result, the decision of the President of UOKiK of November 30, 2021 was finally repealed.

The Court of Appeal fully accepted the arguments presented by Eurocash throughout the proceedings, finding no grounds to attribute the alleged violations to the company. The judgment brings the proceedings to a final close and confirms the correctness of the position Eurocash has maintained from the outset.
