SK&S Secures Final Victory for Eurocash in Dispute with the President of UOKiK

SK&S lawyers successfully represented Eurocash in a long-running dispute with the President of UOKiK concerning a decision imposing a PLN 76 million fine on the company for the alleged unfair exploitation of superior bargaining power vis-à-vis suppliers of agricultural and food products.

The case was definitively concluded when the Supreme Court refused to admit for consideration a cassation appeal filed by the President of UOKiK against the judgment of the Warsaw Court of Appeal of 27 January 2026. As a result, the final judgment setting aside UOKiK’s decision of 30 November 2021 remains in force.

The decision had previously been set aside in its entirety by the Court of Competition and Consumer Protection (SOKiK), and the President of UOKiK’s appeal was subsequently dismissed by the Court of Appeal. The courts upheld the arguments advanced by Eurocash throughout the proceedings, finding no grounds for attributing the alleged infringements to the company.

The ruling brings to an end one of the most significant disputes concerning superior bargaining power in the Polish food sector and confirms the correctness of the position consistently maintained by Eurocash from the outset of the proceedings.
