With the projected economic slowdown, insolvency will gain increased prominence not only in Poland but also worldwide. Therefore, it is crucial to examine the relationship between bankruptcy and insolvency regimes and arbitration, not only at the national level but also within the EU. What are the implications of declaring bankruptcy on arbitration clauses and ongoing arbitration proceedings? Will the present regulations in bankruptcy and restructuring law prevent a recurrence of the Vivendi v Elektrim case?
